Divorce FAQs

Q:  What are the residency requirements?

A:  One party must live in Michigan for at least the 180 days and in the County of filing for at least the 10 days prior to the filing of the suit for divorce.

Q:  How long does it take to get a divorce?

A:  If there are minor children then at least 6 months.  If there are no minor children then at least 90 days.  However, you should expect to at least double that time if either party contests property division, child custody, child support or spousal support.

Q:  Is fault important?

A:  Michigan is a no-fault state; fault need not be shown to get a divorce.  However, in some circumstances, fault may play into property division or child custody.

Q:  Am I entitled to a jury trial.

A:  No.  If there is a trial it will be solely in front of a judge and/or a referee.

Q:  What about mediation?

A:  Courts like to order mediation and almost always do in divorce cases.  Voluntary mediation is also a very good thing.

Q:  What does it cost to get divorced?

A:  The filing fees are less than $300 in Michigan.  However, divorce is a very detail-oriented, paperwork-intensive process.  Divorces with minor children involved are much more expensive than those without.  Please call our office at 734.272.4771 for more information.

Q:  Who is the Friend of the Court and what does s/he do?

A:  The Friend of the Court is appointed to conduct investigations and make recommendations to the Court.  The FOC's recommendation is often followed by the Court.  The FOC is also responsible, in most cases for enforcement and collection of child support obligations.
